Each case is highly fact-specific, and before the analysis even begins on an amount, the Court must decide if the party requesting the support is qualified. If the Court finds that there are grounds to award spousal support, it will then review a number of statutory factors to determine the nature, amount, duration, and payment method of support.
The 11 Statutory Factors the Court Considers
- 1Each spouse's ability to provide for their minimum reasonable needs independently, considering financial resources on dissolution of the marriage
- 2The education and employment skills of the spouses, the time necessary to acquire sufficient education or training to enable the spouse seeking support to earn sufficient income, and the availability and feasibility of that education or training
- 3The duration of the marriage
- 4The age, employment history, earning ability, and physical and emotional condition of the spouse seeking maintenance
- 5The effect on each spouse's ability to provide for their minimum reasonable needs while providing periodic child support payments or maintenance, if applicable
- 6Acts by either spouse resulting in excessive or abnormal expenditures or destruction, concealment, or fraudulent disposition of community property, joint tenancy, or other property held in common
- 7The contribution by one spouse to the education, training, or increased earning power of the other spouse

What Qualifies You for Spousal Support in Texas?
In Texas, spousal support can be petitioned by either party. The Court requires the requesting spouse to demonstrate financial need plus at least one of the following qualifying circumstances.

How Is Spousal Support Calculated in Texas?
Spousal support is an income-based calculation with a number of factors that affect the amount and duration. Texas law imposes strict caps on both the amount and duration of spousal support awards.
Maximum Monthly Amount
The Court may order a maximum of $5,000 per month or 20% of the paying spouse's average monthly gross income, whichever is less.
Duration Caps
Texas law caps spousal support duration between 5 and 10 years, based generally on the length of the marriage. Longer marriages may qualify for longer support periods.
Rebuttable Presumption
Texas law presumes that neither party needs spousal support. Evidence must be provided to overcome this presumption — it is not automatically granted.
